Affordable Care Act (ACA) Health Insurance Marketplace Employee Notice

One of the provisions of the Affordable Care Act (ACA) requires employers to distribute the Health Insurance Marketplace Employee Notice to all employees.

The purpose of the Notice is to inform employees of the availability for health insurance coverage through the Covered California marketplace.Covered California is targeted to individuals that are not eligible or do not have access to health insurance benefits through CSU, another employer or government program.

Affordable Care Act (ACA) Eligible Employees

If you do not meet the standard criteria for benefits eligible employees, you may be eligible to enroll in CalPERS health benefits or FlexCash under ACA if you meet any of the following criteria:

  • You work an average of 130 hours per month based on an annual review of computed timebase or reported hours during a 12-month measurement period, or
  • You are appointed with at least a .75 timebase or higher regardless of length of appointment (duration) or initially hired to work at least 130 hours per month.

Hours worked with any CSU campus are to be incorporated into the applicable 12-month measurement period for ACA hours and used to determine employee status. An Introduction to the ACA and ACA Eligibility

The federal ACA was enacted to provide broader health insurance coverage to U.S. workers by partnering with employers to expand eligibility for their health insurance programs. The following CSU employee groups that were formerly not eligible for the CalPERS health benefits may become eligible under ACA:

  • Hourly/Intermittent
  • Temporary /Emergency Hire with a timebase/FTE working 6 months or less
  • Special Consultants (Immediate Pay)
  • Instructional Faculty, Special Programs, Summer Extension (Immediate Pay)

To comply with the Shared Responsibility Provisions of the ACA for employees who do not have a timebase or hours associated with their appointment, departments will report an equivalent of hours worked in order to determine ACA benefits eligibility.

  • The CSU will credit adjunct faculty appointed without a timebase or via hours (Immediate Pay) with 45 hours worked per Weighted Teaching Unit (WTU) (at semester campuses). This is based on 3 hours of service per week per WTU for a 15-week semester. This incorporates classroom time, class preparation, and non-classroom time.
  • CSULB is responsible for determining the appropriate number of hours to credit employees appointed to Extended Education non-credit classifications.
